1. Acceptance of Terms
By downloading, installing, or using the Jacket mobile application (the “App”) operated by Playlist Jacket (“we,” “our,” or “us”), you agree to be bound by these Terms of Use (the “Terms”). If you do not agree to these Terms, do not use the App.
2. Description of Service
Jacket is a playlist cover design tool that allows you to create custom artwork for your Apple Music and Spotify playlists. The App provides templates, editing tools, and integration with music platforms to help you design and apply cover images.
3. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian’s consent to use the App.
4. User Accounts & Third-Party Connections
The App allows you to connect your Apple Music and/or Spotify accounts to access your playlists. By connecting these accounts, you authorize the App to access playlist metadata and, in the case of Spotify, to upload cover images on your behalf. You are responsible for maintaining the security of your third-party account credentials. You may revoke the App’s access at any time through your Spotify account settings or your device’s privacy settings for Apple Music.
5. App Content & Template Licensing
All template artwork, designs, graphics, and other visual assets provided within the App (collectively, “App Content”) are owned by or licensed to Playlist Jacket. App Content is provided for use within the App only and solely for the purpose of creating playlist cover images for your personal or non-commercial use.
You may not:
Extract, download, redistribute, or resell any App Content independently from the App.
Use App Content to create derivative works outside of playlist cover images.
Claim ownership of any App Content or template designs.
Use App Content in any manner that competes with or substitutes for the App.
Cover images you create using the App are yours to use as playlist artwork on Apple Music, Spotify, or for personal sharing purposes.
6. User Content & Conduct
You may upload or import your own images for use as cover backgrounds. You are solely responsible for any content you upload and represent that you have the necessary rights to use it. You agree not to upload content that:
Infringes on any third party’s intellectual property, including copyrighted images, logos, or trademarks.
Contains explicit, obscene, or offensive material.
Violates any applicable law or regulation.
Violates the terms of service of Apple Music or Spotify.
7. Subscriptions & Purchases
Jacket offers a free tier with limited templates and a premium subscription that unlocks additional features. All purchases are processed by Apple through the App Store and are subject to Apple’s terms and conditions.
Subscription details:
Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage and cancel your subscription in your device’s Settings > Apple ID > Subscriptions.
No refunds are provided for unused portions of a subscription period. Refund requests must be directed to Apple.
8. Intellectual Property
The App, including its design, code, templates, graphics, and overall appearance, is the intellectual property of Playlist Jacket and is protected by copyright and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited license to use it as described herein.
9. Copyright Complaints
We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes upon any copyright you own or control, please immediately report it to us at info@playlistjacket.com.
10. Third-Party Services
The App integrates with third-party services including Apple Music, Spotify, Unsplash, and RevenueCat. Your use of these services through the App is also subject to their respective terms of service and privacy policies. We are not responsible for the practices or availability of any third-party service.
11. Disclaimers
The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
We are not affiliated with, endorsed by, or sponsored by Apple, Spotify, or Unsplash. Apple Music and Spotify are trademarks of their respective owners.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Playlist Jacket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify, defend, and hold harmless Playlist Jacket from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the App, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
14. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the App at any time by deleting it from your device.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
